“Agnello hit back — with a counterclaim for $2,500 that he said covers the value of his destroyed bicycle, the time he spent recuperating, and the sheer aggravation of the ordeal. 

But, he said, he would settle for Cook dropping his claim. “

A) his bike should have been paid for by insurance already

B.) He shouldn’t drop his counter suit under any circumstances.

In a lot of other nations, a claimant who brings a lawsuit and loses has to pay the winning defendants costs, including lawyers, court fees, time lost from work, etc.

That stops frivolous lawsuits.  There was a case where a lawyer said a ma-pa laundry in Washington D.C. ruined a $40 shirt.  The laundry showed pictures of the shirt being brought in with the marks.  Nevertheless, the lawyer, at virtually no cost to him, kept bringing all kind of lawsuits against the laundry until it cost the ma-pa shop so much they had to close the business.  The lawyer lost every time but he knew he would cost the laundry lots of money each time vs virtually nothing for him.

But you realize, I am sure, that a system such as yours would make the poor EVEN MORE vulnerable than they already are to the legal system?  IOW, a poor person gets hit by a rich person, and is NEVER going to sue since cost of the the rich person's legal team alone would bankrupt the poor person in the event of a loss -  highly likely loss?
