Synopsis: The Prince William County prosecutors want to serve a "search warrant" on a 17 year old male that would enable the police to take the teen to a hospital, inject him with a drug that would cause an erection, which the police would then film as evidence.  The prosecutors allege that this would allow them to identify his member as that which was sent to his 15 year old girlfriend in a text video.  The story states that this started when the girl sent him a sext message of herself and a video was sent to her phone.  Her mother saw the video and filed charges.  The video does not identify a person, only an erect penis.  The police have already taken a picture of the boy's bits at juvenile lockup but apparently do not have sufficient proof that the photo is the same as the video.

 

Is this as messed up as I think it is or do you think that the crime committed justifies the heavy-handed response from the prosecutor's office and the PO-lice?

And yes this is taking it a bit far if that is all there is to the story.  kids have been and will continue to play doctor, etc for years.  Now they just do it with technology instead of face to face behind the wood shed.

Road runner, the problem that I have is a violation of unreasonable search and seizure.  They're going to inject him with drugs to force an erection, take a video for the prosecution.  Shouldn't the citizens of the US expect to have some level of privacy?  You think that injecting people with drugs is ok? Nothing wrong with that?  As long as it isn't you I guess.

If it was any other body part, no one would have a problem with inspection to see if it was as described by a witness or victim.  This is a particular part that can only be identified if erect, so why not?

The erection was caused by something the 15 year old sent him.  Make her go in his cell and repeat it.  Film that.

Huh.  It seems weird that they would be such lunatics about this if she was sexting him and he fired back a dick pic when both were minors.  Kids are mostly banging at 13 these days, it isn't like that would have been the first time the girl had seen his dong or anything if they were bf/gf at the time.

So the sex act between a 15 and 17 yo isn’t illegal, it’s not statutory rape due to their closeness in age per Virginia State law. But the Police filming or taking pictures of it would be.

Is this why his rights were violated per the court case?  I did not read in full.  Just a quick scan.

It doesn’t appear statutory rape is the issue. It’s the child porn laws regarding the images sent by a minor of his penis.  

I wouldn’t have gone there with the kid, it seems like a reach and the courts agreed.

I don’t think anyone thought it was fine. Its a matter of what can you prove and how far are you willing to go to prove it.

It was an overreach by LE.

I didn’t read up on the statuary rape laws of that state at that time but yeah appears so.

Back in the 80’s the statutory rape laws in VA was 16 IIRC.  Under the UCMJ it was ridiculously low, like 14. I’m sure they have changed since.

I didn't read much of this thread (no one does), but I think the COVID vaccine was going to be used.  One of the side effects they don't talk about(!) as the nanobots seem to steal the spotlight.

There was an old fella at work, nearing retirement he would wax poetic and try to pass on his hard earned knowledge.

He knew a lot about furnaces, and trained a lot of young fellows on the finer points of tuning a burner, and balancing multiple burners to get even heating
