I have done that for awhile it had done no good..at least this guy knows there is a problem..but there would be an age discrimination lawsuit if they let her go..So now he meets with her every Monday and they are watching her.

Sorry to hear... CA is an extremely litigious & employee friendly state so I get the concern but if there is documented performance issues and a corrective action plan with documented expectations they can win a lawsuit. 

But then they have to defend the lawsuit $$$...
